While our products are designed for children, all purchases must be made by adults. Parents, guardians, therapists, or other authorized adults may purchase products on behalf of children.

3.1 Product Description

The Batting Joy is a therapeutic baseball learning device designed to support motor skill development, sensory processing, and joyful play. Our product is designed with input from occupational therapists and is intended as a therapeutic tool, not a medical device.

3.2 Pricing

• Product Price: $29.95 per unit (USD)
• Shipping Cost: $5.99+ (United States only)
• Minimum Order: 1 unit
• Maximum Order (Online): 10 units
• Bulk Orders: For orders of 3 or more units, please contact team@battingjtllc.com for potential volume pricing

3.3 Price Changes

We reserve the right to modify our prices at any time. Price changes will not affect orders that have already been placed and confirmed.

4. Orders & Payment

4.1 Order Placement

When you place an order through our website, you are making an offer to purchase our product. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

4.2 Payment Processing

All payments are processed securely through Stripe, a third-party payment processor. We do not store your complete credit card information on our servers. By providing payment information, you authorize us to charge the total amount of your order (including product price, shipping, and any applicable taxes) to your payment method.

Payment is due at the time of purchase. Your use of Stripe's payment processing services is also subject to Stripe's Terms of Service and Privacy Policy.

4.3 Order Confirmation

Upon successful payment, you will receive an order confirmation email containing your order details and a unique order ID (format: BJT-XXXXX-XXXXX). Please retain this email for your records.

4.4 Order Processing Time

Orders are typically processed within 1-2 business days (Monday-Friday, excluding federal holidays). You will receive a shipping confirmation email when your order ships.

5. Shipping & Delivery

5.1 Shipping Locations

At this time, we only ship within the United States. We do not ship to P.O. boxes, APO/FPO addresses, or international destinations.

5.2 Delivery Timeframe

Standard shipping typically takes 5-7 business days after your order is processed. Please note that delivery times are estimates and not guaranteed. Batting Joy LLC is not responsible for delays caused by shipping carriers or circumstances beyond our control.

5.3 Shipping Address

You are responsible for providing an accurate shipping address. We are not responsible for orders shipped to incorrect addresses provided by the customer. If an order is returned to us due to an incorrect address, you may be responsible for additional shipping charges to reship the product.

5.4 Lost or Damaged Shipments

If your order arrives damaged or is lost in transit, please contact us at orders@battingjtllc.com within 7 days of the expected delivery date. We will work with you and the shipping carrier to resolve the issue.

6. Returns & Refunds

6.1 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee on all purchases. If you are not completely satisfied with your Batting Joy, you may return it within 30 days of delivery for a full refund of the product price.

6.2 Return Conditions

To be eligible for a return:

• The product must be returned within 30 days of delivery
• The product must be in its original condition (gently used products are acceptable)
• You must contact us at support@battingjtllc.com to initiate the return process
• You must include your order ID in your return request

6.3 Return Shipping

Customers are responsible for return shipping costs unless the product was defective or damaged upon arrival. We recommend using a trackable shipping method for returns.

6.4 Refund Processing

Once we receive and inspect your returned product, we will process your refund within 5-7 business days. Refunds will be issued to the original payment method. Please note that the original shipping fee is non-refundable unless the return is due to our error or a defective product.

6.5 No Extended Warranty

Beyond our 30-day money-back guarantee, we do not offer an extended warranty. The product is provided on an "as-is" basis after the 30-day return period, subject to applicable consumer protection laws.

10. Dispute Resolution & Arbitration

10.1 Informal Resolution

Before initiating arbitration or litigation, you agree to first contact us at support@battingjtllc.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice.

10.2 Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms, our products, or our services shall be settled by binding arbitration in accordance with the Federal Arbitration Act and the Commercial Arbitration Rules of the American Arbitration Association (AAA).

10.3 Arbitration Procedures

• The arbitration shall take place in Florida or remotely via video conference
• The arbitrator's decision shall be final and binding
• Judgment on the arbitration award may be entered in any court having jurisdiction
• Each party shall bear its own costs and attorneys' fees unless otherwise awarded by the arbitrator

10.4 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You expressly waive your right to participate in a class action lawsuit or class-wide arbitration.

10.5 Exceptions to Arbitration

Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies. Additionally, either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

10.6 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida and the Federal Arbitration Act, without regard to conflict of law principles.
